Criteria for Eligibility
- Must be at least 18 years old at the time of the offense
- Must be a first-time offender
- Offender must admit guilt
- Offense cannot be charged with a Class A felony
- Offense cannot involve serious physical injury, death, a victim under the age of 14, or a sex offense involving forcible compulsion or incapacity of a victim, a law enforcement officer, a school officer, a correctional officer, active duty military personnel of the United States military, or a person over the age of 65
- Offender must not have any other pending charges
- Offender is charged with a criminal offense within the jurisdiction of Morgan County, 8th Judicial Circuit
- Must be approved by the District Attorney and subject to judicial approval
Criteria for Acceptance
- Justice is served by enrollment in the Pretrial Intervention Program (“PTIP”)
- The needs of the State of Alabama are met through PTIP
- Offender poses no substantial threat to the safety or well-being of the community
- Must have approval of the victim and arresting agency
- Offender is unlikely to be involved in further criminal activity
- Offender will likely respond to rehabilitative treatment
- Offender does not have an extensive criminal history
- Offender will be subject to an Administration Fee at the time PTIP Agreement is signed and must comply with all terms of the PTIP Agreement and Mandatory Rules
- Must agree to pay restitution, if applicable, and any assessed court costs, attorney fees, drug screens, counseling/treatment programs, educational costs and/or monitoring fees
- Must agree to maintain employment
- Offender must have read or been explained and understand all terms and conditions of the PTIP Agreement and the District Attorney’s Mandatory Rules for PTIP
The District Attorney has the authority to deny any person from PTIP. In the event an offender is denied, or even terminated from program, the case will be sent back to the original presiding judge for further proceedings.
